The Plaintiff, William F., has filed this lawsuit against Cigna Group Insurance (Cigna), Life Insurance Company of North America (Life), and Ralcorp Holdings, Inc. (Ralcorp) for the improper denial of disability benefits.

This lawsuit, filed with the help of an Arkansas Disability attorney in Federal Court, seeks payment of disability benefits that were denied to him by the aforementioned Defendants.

Facts of the Case Against Cigna, Life, and Ralcorp

Plaintiff was enrolled in an employee benefit plan that was administered by Cigna, underwritten by Life, and that also involved Ralcorp. As such, if William F. became disabled he was therefore entitled to short-term and long-term disability benefits.

Plaintiff is in fact disabled due to right shoulder acromioclavicular degenerative joint disease and impingement syndrome with possible rotator cuff tear and cervical disc disease with bulging disc and carpal tunnel syndrome. Because of this disability, William F. filed an application for disability benefits with the defendants.

Denial of Disability Benefits by Defendants

Cigna, Life, and Ralcorp denied the Plaintiff’s application for benefits. Plaintiff filed an appeal of this decision, but the Defendants never responded to the appeal within the 45-day time frame as required by the terms of the Plan. Plaintiff decided to sue the Defendants which resulted in the Defendants paying the Plaintiff the backpay benefits that were owed at that particular time. As a result, the Plaintiff dismissed an earlier lawsuit.

However, the Defendants again failed to pay benefits since the dismissal of the previous lawsuit. The Plaintiff has made multiple requests to gain these benefits that are rightly his according to the terms of the Plan. His requests have been unanswered.

Reason for Lawsuit Against Defendants

Plaintiff claims that the initial denial and delay in responding to his appeal has caused considerable damage to the Plaintiff, of which the Defendants should be liable for.

Plaintiff Seeks Following Relief From Cigna, Life, and Ralcorp

The Plaintiff asks the Court to grant the following relief:

  • All past and future disability benefits that are due to the Plaintiff.
  • All accrued interest from not paying the benefits.
  • All associated court costs.
  • All reasonable attorneys’ fees.
  • All other compensation that the Court decides to be just and proper.
