We often see that a disability insurance company will wrongfully deny a person disabled by headaches when the CT scan or MRI brain is normal. More than 99% of the individuals receiving disability benefits as a result of headaches and migraines have normal CT scans and MRIs. Headache disability applications are generally based on subjective complaints. A disability claimant must be prepared to properly document all of the limitations caused on a daily basis by his/her headaches. It is also common that a disability claimant will have secondary medical conditions such as eye pain, depression, anxiety, sleep disorder and cognitive limitations.

Arizona Court Upholds Life Insurance Co. of No. America (CIGNA) Disability Benefit Denial

In Anderson v. Life Insurance Company of North America (LINA), the Arizona federal court upheld LINA’s denial of short term and long term disability benefits to the plaintiff even though it acknowledged the medical evidence supported her claim to be suffering from numerous medical symptoms. The fact that she suffered from these symptoms did not qualify her for disability benefits when, according to the court, “The record demonstrates that Anderson’s symptoms, at their worst, caused her no greater than mild impairment or slightly below average cognitive performance. In light of that level of impairment, Anderson fails to carry her burden of establishing her inability to continue performing her duties as an account manager.”

Former Northwestern Mutual Insurance Agent Sues Northwestern Mutual for Denial of His Disability Benefits

A former insurance agent for the Northwestern Mutual Life Insurance Company and his Idaho disability attorney filed a lawsuit against the insurer in Idaho Federal Court to recover his disability insurance benefits. In May 1970, Roger C. purchased a disability insurance policy from his own employer Northwestern Mutual Insurance Company (NWM) and subsequently purchased a second disability insurance policy in 1975. In addition, from 1970 until 1994 Roger C. added several life insurance policies from NWM to his portfolio of insurance coverage. And, having paid all premiums for the two (2) NWM policies as well as his other NWM life insurance policies, Roger C. rightfully expected to be fully covered by those policies should he become disabled, which he did in 2005. Unfortunately, NWM denied his claims for benefits.
